High Court Fines Lawyer 25,000 Taka for Concealing Information in Bail Plea

The High Court on Sunday imposed a 25,000 taka fine on a lawyer for concealing material facts during a bail application hearing. The order was issued by a bench comprising Justice Sheikh Md. Zakir Hossain and Justice Md. Zakir Hossain.
The case involved a bail petition filed on behalf of an accused identified as Sakib, also known as Sakib Hasan Liton, regarding a case in Patuakhali. The matter was listed as item number 15 on the court’s daily cause list. During the proceedings, Deputy Attorney General Sultan Mahmud informed the court that the legal counsel had withheld critical information, leading the bench to reject the bail petition and levy the fine against the lawyer, Mohammad Azizur Rahman.
According to Deputy Attorney General Sultan Mahmud, the bail application had been submitted to this specific High Court bench on July 26 and remained pending on the cause list. Despite this, the same legal representative submitted an application using the identical tender number to a different High Court bench. That bench subsequently removed the matter from its list on August 3. Under established judicial procedure, a single tender number is restricted to one court to prevent forum shopping.
The court demanded an explanation from Mohammad Azizur Rahman after the discrepancies were brought to its attention. Deputy Attorney General Sultan Mahmud stated that the lawyer failed to provide a satisfactory response, prompting the court to issue the fine.
Commenting on the ruling, Attorney General Md. Ruhul Quddus Kajol emphasized that presenting accurate and complete information is a fundamental professional obligation for legal practitioners. He noted that attempting to influence judicial outcomes by hiding previous proceedings or seeking hearings in multiple benches is not only a violation of professional ethics but also undermines public confidence in the judicial process.
