Appeal hearing against Aslam and Sarwar’s candidature on June 9

June 9 has been fixed for the hearing of separate appeals against the candidature of BNP candidate Aslam Chowdhury in Chittagong-4 seat and Sarwar Alamgir candidate of Chittagong-2 seat in the 13th National Assembly elections.

At the same time, separate application made by this candidate of BNP for publication of the gazette and oath of the results of the suspended polls has been placed on record. The Appellate Division headed by Chief Justice Zubair Rahman Chowdhury gave this order on Thursday.

Thirteenth National Parliament election was held last February 12. Aslam Chowdhury as BNP candidate in Chittagong-4 constituency and Sarwar Alamgir in Chittagong-2 constituency. However, the publication of their results in the election is suspended by the court’s decision.

Aslam Chowdhury’s candidature in Chittagong-4 constituency is upheld by the order of the High Court before the election. On the other hand, Sarwar Alamgir, the candidate of Chittagong-2 constituency, got his candidature back by writ in the High Court.

Jamaat-e-Islami candidate Anwar Siddiqui filed leave to appeal against the High Court’s order to uphold Aslam Chowdhury’s candidature. On the other hand, Jamaat’s candidate Muhammad Nurul Amin filed a leave to appeal against the order of the High Court rejecting the candidature of Sarwar Alamgir. They made this application alleging default.

The Appellate Division gave an order on February 3 by granting separate leave to appeal filed by these two candidates of Jamaat. A separate order states that if they (Aslam Chowdhury and Sarwar Alamgir) are successful as candidates in the election, the publication of the election results of the respective constituencies (as far as applicable to them as candidates) shall be suspended till the final disposal of the appeal.

After the leave to appeal was granted, these two Jamaat candidates filed separate appeals on March 31. On April 28, the Chamber Court of the Appellate Division appointed the regular bench of the Appellate Division to hear the appeal.

In the previous continuation, two appeals came up for the agenda yesterday on Wednesday. Along with the appeal, separate applications of two BNP candidates for gazette publication and oath also came up in the agenda. Two candidates of BNP filed two separate applications seeking revision of the February 3 order of the Appellate Division. The Appellate Division set today for the hearing order.

Senior lawyer Mohammad Shishir Monir heard on behalf of the appellants in the court. Senior lawyer Nihad Kabir and Mostafizur Rahman Khan heard on behalf of Aslam Chowdhury, accompanied by lawyer Rokon Uddin Md. Farooq. Senior lawyer Ahsanul Karim was in the hearing on behalf of Sarwar Alamgir.

Later, senior lawyer Ahsanul Karim told Prothom Alo that the Appellate Division has set the date of June 9 for hearing the appeal after registering the application made by two candidates of BNP for publication of the gazette and oath.
