Supreme Court Orders High Court to Resolve Chittagong-2 BNP Candidate Eligibility Dispute

The Supreme Court of Bangladesh has ordered the High Court to resolve the legal dispute surrounding the candidacy of BNP nominee Sarwar Alamgir for the Chittagong-2 constituency, effectively maintaining the suspension of the election results for that seat.
A five-member Appellate Division bench, led by Chief Justice Zubayer Rahman Chowdhury, issued the directive on Tuesday. The ruling follows an appeal filed by Muhammad Nurul Amin, a Jamaat-e-Islami candidate for the same constituency, who challenged Alamgir’s eligibility on grounds of alleged loan default.
The legal impasse stems from the 13th parliamentary election held on February 12. Although Alamgir initially had his nomination paper rejected by the Election Commission, he successfully petitioned the High Court on January 27 to allow his participation and secure the allocation of the “sheaf of paddy” symbol. Following this, the Jamaat candidate sought a review, leading to a February 3 order from the Appellate Division which stipulated that if Alamgir contested the poll, his results would remain withheld pending a final adjudication of the dispute.
Following a series of procedural hearings scheduled through the spring, the Appellate Division has now mandated that the High Court dispose of the rule regarding Alamgir’s candidacy within two weeks.
Senior lawyer Ahsanul Karim, representing Alamgir, confirmed that the existing stay on the announcement of election results and the administration of the oath of office for the candidate will remain in effect until the High Court reaches a final verdict. Consequently, the electoral outcome for Chittagong-2 will stay in legal limbo until the lower court completes its review.
