High Court orders formation of committee to expedite delivery of Supreme Court bail orders

The High Court has directed the Registrar General of the Supreme Court to form a committee within seven days to establish a formal policy for the rapid transmission of bail orders between the Appellate and High Court divisions and lower courts. The directive was issued on Monday by a High Court bench comprising Justice Md. Habibul Gani and Justice Syed Mohammad Tazrul Hossain, following the primary hearing of a writ petition.

The petition, filed in May by seven lawyers, sought judicial intervention to address systemic delays in the communication of bail orders, which often take weeks to reach lower courts. The petitioners argued that such delays effectively undermine the purpose of judicial relief, as bail should become legally effective the moment it is granted.

Senior lawyer Mohammad Shishir Monir, who represented the petitioners alongside colleagues Mohammad Saddam Hossain and Zayed Bin Amjad, emphasized the need for a “real-time” communication system. He noted that the current administrative lag prevents defendants from securing their release promptly despite having been granted bail by the higher courts.

The court has mandated that the newly formed committee draft comprehensive guidelines to modernize the transmission process. The Registrar General is required to inform the court of the committee’s formation and submit a progress report on the proposed policy by August 20.

Drawing a parallel to judicial reforms in neighboring jurisdictions, the petitioners pointed to the Supreme Court of India, which has already successfully implemented digital communication protocols to ensure the instantaneous transmission of bail orders. The High Court’s directive aims to replicate such efficiency, tasking the committee with determining whether the solution lies in a fully digitized online system or a significant overhaul of existing communication protocols. The state was represented during the hearing by Deputy Attorney General Muhammad Jisan Haydar.
