High Court sets Wednesday hearing for BNP candidate nomination dispute in Chittagong-2

The High Court has scheduled a hearing for this coming Wednesday to determine the validity of the disqualification of Sarwar Alamgir, the Bangladesh Nationalist Party (BNP) candidate for the Chattogram-2 constituency during the 13th parliamentary election. The bench, comprised of Justice Fahmida Kader and Justice Md. Asif Hassan, set the date during proceedings on Sunday.

The status of the Chattogram-2 election remains in a state of legal limbo, with the official results currently withheld by court order. The controversy began when the Election Commission disqualified Alamgir’s candidacy prior to the February 12 poll. Alamgir subsequently challenged the decision in the High Court, which issued a rule on January 27 granting him permission to participate and directing the allocation of the “sheaf of paddy” symbol to his campaign.

The legal impasse deepened when rival candidate Muhammad Nurul Amin, representing the Jamaat-e-Islami, filed a petition challenging Alamgir’s eligibility, citing allegations of loan default. Following an initial appeal, the Appellate Division ruled on February 3 that, should Alamgir be successful at the polls, the publication of his specific election results would remain suspended pending the final resolution of the legal dispute.

In a follow-up session held on June 16, the Appellate Division formally disposed of the appeal and issued a directive for the High Court to reach a final decision on the underlying rule within two weeks. The court further clarified that the stay on the publication of election results for the contested seat would remain in effect until the High Court concludes its deliberations.

During Sunday’s proceedings, senior lawyer Ahsanul Karim, representing Alamgir alongside advocate Md. Anwar Hossain, confirmed that the bench had placed the writ petition on the cause list for a definitive hearing. Following the court’s scheduling, legal counsel confirmed that the proceedings are set to resume on Wednesday, June 24.
