The investigation report was not submitted even after one and a half years, Taufiq-Dipu Moni-Kamal asked for bail

Former Prime Minister Sheikh Hasina’s adviser Taufiq-e-Ilahi Chowdhury, former minister Dipu Moni and former state minister Kamal Ahmed Majumdar have sought bail from a case of crimes against humanity as the investigation report has not been submitted after one and a half years. In view of this application, the International Criminal Tribunal has asked to submit a progress report on the charges brought against the three accused. Besides, the tribunal said, after receiving the progress report, they will seriously consider their bail.
Today, Sunday, Justice Md. The three-member International Criminal Tribunal-1, headed by Golam Mortuza Majumder, ordered the submission of a progress report on July 26. The other two members of the tribunal are Justice Md. Shafiul Alam Mahmud and Judge Md. Mohitul Haque Enam Chowdhury.
Former Minister Amir Hossain Amu, Md. in a case of crimes against humanity committed during the July uprising. Abdur Razzak, Kamrul Islam, Dipu Moni, Golam Dastgir Gazi and Shajahan Khan, former Prime Minister’s advisor Taufiq-e-Ilahi Chowdhury, former member of parliament Solaiman Salim, former secretary Md. Jahangir Alam and retired Justice AHM Shamsuddin Chowdhury Manik were produced in the tribunal today.
In today’s hearing at the tribunal, the prosecution (lawyer for the state) sought three months to file its investigation report in the case. The tribunal granted time and fixed the date of submission of the report on July 26.
Then Taufiq-e-Ilahi Chowdhury’s lawyer Sheikh Ali Ahmed Khokon told the tribunal that the tribunal can grant bail to the accused at any stage of the trial. Even if the inquiry report is not filed against the accused within one year, there is an opportunity to grant bail. His client is in jail after being arrested in this case for one and a half years. Tawfiq-e-Ilahi was not a member of Awami League. He was the former Prime Minister’s Energy Advisor. His advice may or may not be accepted by the government. There is no picture, video or video of Tawfiq-e-Ilahi inciting or playing any role during the July uprising. He was also not present at the 14-party alliance meeting. Highlighting this position, he wants his client’s bail.
Later, Kamal Ahmed Majumdar’s lawyer Syed Mizanur Rahman said that his client has been in jail for one and a half years. A report has not been filed against him yet. His client is hospitalized. In this situation, this lawyer wants Kamal Ahmed’s bail.
Dipu Moni’s lawyer Sifat Mahmud said that his client has been in jail for 1 year and 5 months in this case. Considering the overall situation, he wants Dipu Moni’s bail.
Regarding these three accused, the tribunal said, on the next scheduled date (July 26) of this case, the ‘progress report’ (progress report) should be submitted regarding Tawfiq-e-Ilahi Chowdhury, Dipu Moni and Kamal Ahmed Majumdar. Then they will look at the issue of bail ‘seriously’.
When asked about the ‘progress report’, the prosecutor of the tribunal said. Mizanul Islam told Prothom Alo that the progress of the investigation on the accused or the stage of the investigation has been requested.
When asked why the tribunal is asking to give such a report, prosecutor Mizanul Islam said, it is not mandatory, but the general rule is that if someone is arrested, a report must be given within one year. One of the other reasons for their bail application is that they have sought bail as one year has passed. The tribunal can grant another six months.
The Rules of Procedure of the Tribunal Act state that if an accused is in custody during the course of investigation, the Inquiry Officer shall complete the investigation within one year from the date of his arrest under the Rules. In case of failure to complete the investigation within the stipulated time, the tribunal may release the accused on bail subject to certain conditions. But in exceptional circumstances, the Tribunal may extend the period of investigation and order the custody of the accused by up to six months, specifying the reasons in writing.
