Ruling on failure to stop river pollution activities of two industries in Sherpur of Bogra

The High Court ruled that the failure to stop the pollution of Phuljor, Kartoa and Bangali rivers by the untreated effluents of two industrial plants located in Sherpur in Bogra should not be declared illegal and against public interest. The two industries are SR Chemical Industries and Majumdar Products Limited.

The High Court bench consisting of Justice Bhishmadev Chakraborty and Justice Abdur Rahman gave a ruling on the preliminary hearing of a writ petition. According to the provisions of the law, the rule also sought to know why the two institutions should not be ordered to stop the pollution activities and protect the Phuljor, Karatoa and Bangali rivers from pollution.

Bangladesh Environmental Law Association (BELA) filed that writ. Lawyers Minhajul Haque Chowdhury and S. Hasanul Banna were in the hearing for the writ in the court. Lawyer Rumana Sharmin assisted them.

Lawyer S. Hasanul Banna told Prothom Alo after informing about the matter of the rule, 12 defendants including the Secretary of the Ministry of Water Resources and the Secretary of the Environment have been asked to respond to the rule. Besides, the court kept this writ for hearing along with the separate writ of SR Chemical Industries and Majumdar Products Limited in 2024.

In a press release, Bela informed that SR Chemical Industries and Majumdar Products Limited (Rice Bran Oil) are located in Sherpur Upazila of Bogra District, near Phuljor, Karatoa and Bangali Rivers. Biodiversity of Karatoa, Bangali and Phuljor rivers and rivers are in dire straits due to the untreated effluents of the two industrial establishments. The Department of Environment has fined the institutions several times for the pollution allegations. The writ was filed to protect these three rivers and the river’s biodiversity from the continued pollution of the two industries.
