Lawyer Granted Bail in Dhaka Court Proxy Defendant Fraud Case

A lawyer has surrendered before a Dhaka court and secured bail in connection with a case involving a “proxy” defendant who attempted to impersonate an accused in a check dishonor lawsuit.

Additional Chief Metropolitan Magistrate Sefatullah granted bail to lawyer Hammad Emdad Hossain on Monday following a surrender hearing. Sub-Inspector Kamal Hossain of the Dhaka Metropolitan Police (DMP) prosecution division confirmed the development.

The case stems from a complaint filed by government employee Nibedita Ahmed on March 23, 2025, against Nasrin Sikdar regarding a dishonored check valued at 2.9 million taka. When Sikdar failed to appear in court on June 16, the court canceled her bail, issued an arrest warrant, and scheduled the next hearing for August 20.

On June 25, however, lawyer Hammad Emdad Hossain appeared in court on behalf of the defendant and presented Monowara Begum, who attempted to impersonate Nasrin Sikdar to secure bail. Court officials grew suspicious during questioning when the woman could not provide accurate details regarding her identity or the case. Subsequent verification of documents confirmed that she was not the accused.

Following the discovery of the fraud, bench assistant Mia Md. Ibrahim Khalil Opu filed a case against Nasrin Sikdar, the impersonator Monowara Begum, and lawyer Hammad Emdad Hossain. Monowara Begum remains in custody, while the primary accused, Nasrin Sikdar, is currently a fugitive.

Hossain had previously secured an eight-week anticipatory bail from the High Court on June 30. As that term expired, he appeared before the lower court to surrender and request bail. During the hearing, legal counsel representing the accused—including Dhaka Bar Association President Anwar Zahid Bhuiyan—argued that Hossain was at the High Court premises during the incident and that his official seal had been used without his knowledge.

The initial case filing alleges that the defendants conspired to mislead the judicial process by presenting a fraudulent individual to the court. The complaint further claims that Hossain personally filled out the power of attorney and intentionally presented an imposter before the court. The magistrate granted bail until the police investigation report is submitted.
