Bangladesh Supreme Court Clears Path for Appointment of 32,000 Primary School Headmasters

The Appellate Division of the Supreme Court has cleared the path for the recruitment of headmasters in approximately 32,000 government primary schools across Bangladesh, effectively ending a long-standing legal impasse that had crippled administrative appointments. A bench led by Chief Justice Zubayer Rahman Chowdhury delivered the verdict on Thursday, granting the state’s appeal against a previous High Court ruling that had invalidated portions of the recruitment and seniority regulations for teachers from nationalized primary schools.
Attorney General Mohammad Ruddus Kajal confirmed the outcome to reporters, characterizing the decision as a significant victory for the state. The court’s ruling establishes that directly recruited government teachers will hold seniority over those who transitioned from private schools absorbed into the state system. This judicial determination overturns a 2019 High Court judgment that had declared certain provisions of the 2013 recruitment regulations unconstitutional, a move that had triggered years of administrative uncertainty.

According to the Attorney General, the legal dispute had prevented the government from filling thousands of vacant headmaster positions, forcing many schools to rely on ad-hoc arrangements. By resolving these seniority and promotion disputes, the verdict restores the government’s authority to conduct formal recruitment and transfers, which officials expect will bring much-needed institutional discipline to the primary education sector.
The controversy originated in 2017 when teachers from newly nationalized primary schools challenged the 2013 regulations governing their service conditions. While the High Court initially sided with the petitioners, the state filed for leave to appeal, which was granted by the Appellate Division in late 2022. During the pendency of the appeal, the court had suspended the High Court’s ruling, and further appeals were filed by directly recruited teachers seeking to protect their employment status.

Following the final resolution of the matter, the Ministry of Primary and Mass Education is now expected to proceed with the recruitment process for the vacant posts. The legal proceedings involved extensive arguments from the state’s legal team, led by the Attorney General, as well as counsel representing the various cohorts of teachers affected by the regulatory framework.
