Writ on Supreme Court Secretariat Abolition Act

A writ challenging the Supreme Court Secretariat (Abolition) Act. The writ sought directions to maintain the status quo to keep the activities of the Supreme Court Secretariat running.
Mohammad Saddam Hossain along with seven lawyers filed the writ yesterday as petitioner. The writ is numbered 96 in today’s agenda of the High Court bench comprising Justice Ahmed Sohail and Justice Fatema Anwar. Lawyer Saddam Hossain said that the hearing on the writ is scheduled to be held around 2:30 pm.
Earlier, after the final hearing of a writ petition filed by seven lawyers, the High Court ruled on September 2 last year, ordering the establishment of a separate independent secretariat for the Supreme Court within three months. The full judgment of 185 pages was published on the website of the Supreme Court on 7th of this month.
After the announcement of the High Court verdict, the interim government issued an ordinance titled ‘Supreme Court Secretariat Ordinance, 2025’ on November 30 last year. The Supreme Court Secretariat was inaugurated on December 11 of the same year. The Supreme Court Secretariat (Abolition) Bill was passed in the National Assembly on April 9, rejecting the opposition’s objections.
In a press conference that day, the senior lawyer of the writ petitioners Mohammad Shishir Monir said that the writ petition will be filed by challenging the Supreme Court Secretariat (Abolition) Act.
After that, seven lawyers filed the writ yesterday regarding the validity of the Supreme Court Secretariat (Repeal) Act. The writ prayer seeks a ruling as to why the Supreme Court Secretariat (Repeal) Act, 2026 should not be declared unconstitutional. A direction has been sought to the defendants to maintain the status quo to keep the Secretariat’s activities going since December 11 last year while the ruling is under trial. Two secretaries of the Ministry of Law have been made defendants in the writ.
