The state has appealed against the High Court judgment ordering the establishment of a separate independent secretariat for the Supreme Court within three months. The hearing of this appeal has been fixed on June 9.
The hearing will be held in the full bench of the Appellate Division. Appellate Division Chamber Justice Farah Mahbub fixed this date on Thursday.

In the main appeal, the judgment of the High Court has been quashed. Earlier, the High Court gave its verdict on the final hearing of a writ filed by seven lawyers including Mohammad Saddam Hossain on September 2 last year. In the verdict, Article 116 of the existing constitution was declared to be in conflict with the constitution and null and void.
Article 116 of the existing constitution deals with the control and discipline of subordinate courts. In this, the issue of discipline including the appointment, promotion, leave of judicial officers is entrusted to the President. It is stated that the President will implement it in consultation with the Supreme Court.

According to the verdict in the Eighth Amendment and Sixteenth Amendment cases, the High Court said that Article 116 of the 1972 Constitution will be reinstated in the Constitution as it was. At the same time, the verdict directed to establish a separate independent secretariat for the Supreme Court within three months. Apart from this, the issue of certificate under Article 103 of the Constitution for appeals involves important interpretation of the Constitution and the law.
The full 185-page judgment was published on the Supreme Court’s website on April 7 this year. After the announcement of the verdict, the Attorney General said that the state will appeal against the verdict of the High Court.
Following this, the State appealed, which is number 38 in today’s agenda of the Appellate Division Chamber Court. In addition, the state side applied for suspension of the High Court’s judgment until the appeal is disposed of.

Later, senior lawyer Mohammad Shishir Monir said that the chamber court did not stay the decision to establish a separate secretariat. The full bench of the Appellate Division has scheduled the hearing on June 9.
