Khairul Haque Granted Bail in Two More Cases

Former Chief Justice ABM Khairul Haque has been granted interim bail in two separate murder cases filed with the Jatrabari and Adabar police stations in Dhaka, related to events during the July political upheaval.
The High Court bench, comprising Justice KM Zahid Sarwar and Justice Sheikh Abu Taher, issued the bail orders today with a rule, following a hearing on Haque’s petitions.

Earlier, on April 28, the Appellate Division had upheld Haque’s bail in five separate cases, including the murder of a Juba Dal activist in Jatrabari during the same period.
With bail secured in these two new cases, there are currently no legal impediments to Haque’s release from prison, according to his senior lawyer, Md. Mansurul Haque Chowdhury. He informed that Haque’s name was not mentioned in the initial police reports (FIRs) of these two cases. He was shown arrested in these cases after obtaining bail in the earlier five. The High Court has granted him six months of interim bail with a rule.

Information from the concerned lawyers indicates that Haque was shown arrested in these two separate murder cases in Jatrabari and Adabar police stations on March 30, following his High Court bail in the prior five cases.
After his applications were rejected by the lower courts for these two cases, Haque filed separate bail petitions with the High Court on Sunday, which were scheduled for a hearing today.
Representing Haque during the hearings were senior advocates Md. Mansurul Haque Chowdhury, Motahar Hossain Saju, Sayeed Ahmed Raja, and lawyers Jahangir Hossain, Monayem Nabi Shaheen, among others.
The state was represented by Additional Attorney General Muhammad Abdul Jabbar Bhuiyan, Deputy Attorney General Syeda Sajia Sharmin, and Assistant Attorney General Md. Emdadul Hanif.
Khairul Haque served as Chief Justice from September 30, 2010, to May 17, 2011. The Appellate bench led by him delivered a verdict on May 10, 2011, nullifying the Thirteenth Amendment to the Constitution.
Justice Khairul Haque was arrested by police from his residence in Dhanmondi on July 24 last year. He was subsequently shown arrested in the case of the murder of Juba Dal activist Abdul Kaiyum Ahad in Jatrabari during the July political events. He has been in custody since then.
Last year, a case was filed against Haque at Shahbagh police station on August 27 by Supreme Court lawyer Mujahidul Islam Shaheen, accusing him of fabricating a verdict related to the caretaker government system. Simultaneously, on August 25 last year, a man named Nurul Islam Molla filed another case against him at Bandar police station in Narayanganj with similar allegations. Furthermore, the Anti-Corruption Commission (ACC) filed a case against Haque in August last year for allegedly receiving a plot irregularly.
Of these five cases, Haque received bail from the High Court on March 8 in four separate cases, including the murder of a Juba Dal activist in Jatrabari during the July political upheaval and those alleging fabrication of the caretaker government verdict. He secured bail from the High Court on March 11 in the ACC’s case.
The state filed separate appeals seeking to stay the High Court’s bail orders. These applications were listed for hearing at the Appellate Division’s chamber court on April 8. On that day, the court scheduled the applications for hearing by the regular bench of the Appellate Division.
Following this, the Appellate Division heard the appeals on April 28 and dismissed the separate leave to appeal petitions filed by the state, thus upholding Khairul Haque’s bail in five cases, including the murder of a Juba Dal activist in Jatrabari during the July political upheaval.
